Rita Donaghy, the Chair of the Government convened inquiry into construction industry fatalities, has indicated that the prosecution of a construction giant could influence her findings.
Recently at the Old Bailey, where Rita Donaghy was present, Laing O'Rourke was fined £135,000 and told it should be 'thoroughly ashamed' over a workplace fatality. Moreover, the company was told that it must eliminate a 'casual attitude to risk'. Mr Kieron Deeney died at the Discovery Dock scheme in East London when he fell more than 9m through an open, uncovered hole in the floor.

Precautions you should take

Refurbishment and construction works have in the past been the subject of various Health and Safety Executive (HSE) campaigns but little seems to stem the flow of deaths on such sites.
Clients are themselves continually being asked to play a more active role in preventing deaths on site. Indeed the guidance issued by the HSE in respect of the Construction (Design and Management) Regulations 2007 suggests that, as a client, you should;

  • Check competence and resources of all appointees
  • Ensure there are suitable management arrangements for the project welfare facilities
  • Allow sufficient time and resources for all stages
  • Provide pre-construction information to designers and contractors
  • Make sure that construction work does not start unless a construction phase plan is in place and there are adequate welfare facilities on site
  • Provide information relating to the health and safety file to the CDM Coordinator
  • Retain and provide access to the health and safety file
