Warwickshire Fire and Rescue Service Prosecute Owner of Licensed restaurant
According to the Chief Fire Officers Association, Warwickshire Fire and Rescue Service were forced to take out a prosecution against the owner of a local licensed restaurant in Rugby on Wednesday 7th January 2009 for failing to allow an inspection of his premises to take place, to confirm adequate fire safety standards were being met.
Monsur Choudbury, owner of the Masala Lounge Restaurant in Rugby pleaded guilty to obstruction and failure to allow an officer to inspect the premises and fire safety records for his business.
In total Mr Choudbury was fined £1,000 plus £133 costs.
This followed a series of letters to the defendant requesting that appropriate arrangements be made to allow a fire safety audit to take place in his premises.
The case was brought under article 32 (2) (d) of the Fire Safety Order 2005 which requires the proof of the intent of the defendant to obstruct the officer in his/her duty, and article 32 (2) (e). Which required that the defendant provided a reasonable explanation as to why the facilities to carry out the audit were not afforded.
At Ark we would give you some very simple advice: let the fire officers in!
But if it really isn't convenient, then politely tell them so. It is generally not unreasonable to ask them to make a mutually acceptable appointment to allow them to return and confirm your compliance with the law.
Of course, if all your fire risk assessments have been done properly by a competent person and they have been recorded in a report that is easy for the Fire Officer to inspect, then you have nothing to fear.
